Consumer Duty: the three rules

The three Consumer Duty rules require companies to:

  1. Act in good faith towards customers
  2. Avoid causing foreseeable harm to customers
  3. Allow and support customers to 'pursue their financial objectives'

As a company we make sure that we always do the right thing by the customer as explained in this we will outline what we do.

When a customer is asking about finance, we go through our process to determine what are the needs of the customer and what cars will be suitable and affordable for them. We then ask them what their credit profile is like and if they have had any issues in the past to determine what company is best to send the customer application to avoid declines on the customer's credit profile. Once the correct finance company has been selected, we then make sure that the customer knows what they are doing and make sure that they are making the most informed decision. Once the application process has been completed and we have an acceptance or decline we then decide our next steps. If the customer is accepted, we then give the customer adequate time to think and make sure it's the correct decision and affordable for them. If they are rejected, we will then send them to a different lender to see if they can help and be in talks with the customer to see what they would like us to do and to see if finance is the best option for them. Never would we send a customer to the wrong lender for the commission earned.  We only send them to a lender based on the information provided to us and what's best for the customer.

Once a customer comes to the signing part of their agreement, we make sure that we go through the pre contract and make sure that they have a full understanding of what they are signing and have no outstanding questions. Once this has been determined and the customer is happy to sign the documents, we leave them and give them adequate time to read and then complete their signing. Once this is done, we then complete the handover stage and hand the vehicle over to the customers satisfaction.

If a customer has a complaint then we would refer them over to our website to view our complaints policy and tell the customer how we deal with our complaints.

VWF Ltd Disclosure Status

VWF Ltd is authorised and regulated by the Financial Conduct Authority for consumer credit activity and our firm’s registration number is FRN: 1009784, permitted activities allow us to act as a broker and not a lender. You can verify this information by using the registration number 1009784 on the FCA website > https://register.fca.org.uk/s/

We can introduce you to a limited number of selected finance providers and finance brokers who may be able to offer you finance for your vehicle purchase, our role as a finance broker is to determine which lender on our panel will be suitable. Rates are determined by our lender partners based on a number of parameters, e.g. personal circumstances, age of vehicle, balance financed etc.

We will not refer you outside of this panel without your consent. You can ask us for a list of the suppliers who provide our finance and insurance products.

We do not charge a Transaction Fee or Processing Fee. We may receive a commission or other benefits from one of our finance providers should you decide to enter into an agreement with them as a result of our introduction. This would be reflected in your monthly re-payments for your vehicle. If you ask us, we must disclose the value of any such commission for your quotation or proposed agreement. In this eventuality it may take some time to ascertain the exact information so please allow up to 3 working days for us to respond in writing. The amount of commission received may vary depending on the funder selected, terms of funding, amount funded and length of agreement.

Regulated and unregulated activity

For individual customer, ie. personal or consumer, purchases, any finance arrangement introduced by VWF Ltd are regulated by the Financial Conduct Authority.

For purchases made by a company, ie Ltd or LLP, any finance arrangements introduced by VWF Ltd are unregulated.

Any warranty which we provide either underwritten by VWF Ltd or for extended warranty via our Warranty Partner, Warrantywise are unregulated.

'Warrantywise provide a discretionary warranty plan sometimes referred to as ‘non-insured’. Like insured warranties, discretionary cover must follow the terms of the service and maintenance warranty plan. Valid warranty repairs are always covered, for both insured & discretionary companies. A valid warranty repair in either case can’t be rejected.

A discretionary warranty allows for flexibility, it means we can assess repairs and use our discretion in areas that might not be clear-cut. As an additional measure Warrantywise has appointed Edd China as the final arbiter, in the event of a dispute Edd China has the final ‘discretion’. Source Warrantywise 2024
